Britney Spears' DUI arrest unlikely to trigger new conservatorship, expert says
Attorney Sean R. Weissbart says a single DUI arrest would not automatically lead to Britney Spears being placed back under a conservatorship. “Although a DUI arrest could be a factor for the imposition of another conservatorship, by no means would a conviction on a DUI result in the imposition of a conservatorship,” he says, adding that the courts would need to demonstrate the singer is incapable of managing her personal and financial affairs.
Weissbart notes the penalties for a DUI are typically probation, a fine, community service or even incarceration, not the imposition of a conservatorship. He says the court would look for a pattern showing long‑term incapacity — such as untreated mental illness or addiction — and would seek the least restrictive means possible.
He characterizes the recent arrest as “an isolated incident” and doubts Britney’s father, Jamie Spears, would be named as conservator again.
