The Supreme Court found that Trump's use of the International Emergency Economic Powers Act (IEEPA) to justify tariffs was unlawful, and companies affected are seeking compensation. Nintendo, Lenovo, Dyson and Epson are among those pursuing refunds. Nintendo's complaint argues for "Defendants [US government] to promptly refund, with interest, any IEEPA duties paid by Plaintiff [Nintendo] regardless of liquidation status, or alternatively enter a money judgment in the same amount." Both Nintendo and Lenovo are seeking interest on top of refunds.

Legal victories in these cases could set a precedent that makes later suits easier, and Dyson and Epson have already joined the legal action. The situation also raises a question about companies such as Sony: if tariffs are refunded but console prices remain elevated, interim purchasers could be left bearing the cost.
