Nintendo sues US government over 'illegally collected' tariffs
Nintendo is suing the US government over duty fees it calls "illegally collected." In a lawsuit obtained and shared by Aftermath, the company says US President Donald Trump’s "unlawful imposition of tariffs" under the International Emergency Economic Powers Act (IEEPA) caused it to have "suffered injury."
The suit says a series of confusing and contradictory executive orders demanding international tariffs prompted Nintendo to push Switch 2 pre-order dates into 2025 and to change Switch 2 accessory prices in the US.
The Supreme Court has since overturned IEEPA-based tariffs and ordered US Customs and Border Protection to refund companies what it judged to be illegally collected fees. Customs and Border Protection says in a separate suit that it is "not able to comply" with that order, and Nintendo has now brought its own legal action.
