Nintendo of America is suing the U.S. Treasury Department, Homeland Security, and Customs & Border Protection to recover money it paid under tariffs that the Supreme Court declared illegal last month. In a suit filed in the U.S. Court of International Trade, the company’s lawyers say that since February 1, 2025, President Trump collected money from companies shipping products into the United States via "unlawful" executive orders "imposing tariffs on imports" from a long list of countries around the world.

The filing says Nintendo has standing because "[Nintendo of America] has standing to sue because it is the importer of record for goods that were subject to [the tariffs]," and that the company directly "suffered injury" from the Trump-ordered duties. In April 2025, Nintendo delayed pre-orders of the Nintendo Switch 2 and later raised prices on some accessories as a result of the worldwide tariffs.
