The Supreme Court struck down President Trump’s emergency tariff authority, a decision that Justice Brett M. Kavanaugh — who opposed it — warned would create “a mess.” The ruling could require the administration to refund more than $100 billion in tariff revenue to thousands of American importers, an effort unmatched in scale and complexity.

The court left the mechanics of refunds to lower courts and the U.S. Court of International Trade, with Customs and Border Protection and the Treasury Department tasked with carrying them out. Administration lawyers said they would comply with an order to refund unlawful tariffs, but Treasury Secretary Scott Bessent cautioned that litigation over the process could take weeks, months or more: “I’ve got a feeling the American people won’t see it.” President Trump also lamented the decision did not state whether the government should keep the money and predicted prolonged litigation.
