The Senate Agriculture Committee passed its portion of the CLARITY Act on a 12–11 party-line vote on Wednesday, with no Democrats voting in favor, underscoring the bill’s fragile path forward.

Committee Chairman John Boozman called the markup the culmination of months of bipartisan discussions and said talks had been “cordial and substantive,” but every Democrat on the panel ultimately voted against advancing the measure.

Wednesday’s vote covered only the Agriculture jurisdiction — issues treating certain digital assets as commodities and the role of the CFTC — leaving key sections on the SEC, token disclosures, stablecoins and DeFi unresolved in other committees.

The CLARITY Act needs 60 votes to pass the Senate, and Republicans do not have the numbers alone, meaning at least seven Democrats must back the bill; the lack of any Democratic support in the Agriculture vote highlights a major hurdle. The most consequential step remains the Senate Banking Committee, which must act on SEC authority, stablecoin rules and DeFi language. The measure cannot reach the Senate floor until all relevant committees approve their portions, and without changes to attract Democratic backing the bill risks stalling or being pushed closer to the November midterms.
