Florida couple sues clinic after woman says she was implanted with wrong embryo
People reports that a couple filed a lawsuit in Palm Beach County Circuit Court on Jan. 9, alleging the wife was implanted with the wrong embryo at the Fertility Center of Orlando. The plaintiffs, identified as Jane Doe and her husband in court documents, say they began IVF treatment with the clinic in March 2025 and believed the implanted embryo contained the woman’s egg and her husband’s sperm.
The suit says the woman, described as "Caucasian" in the filings, gave birth in early December to a baby girl who had the "appearance of a non-caucasian child," and that genetic testing showed the infant is not biologically related to either parent. The lawsuit expresses concern that someone else may have been implanted with the couple’s embryos and asks the clinic to notify patients who stored embryos there before the plaintiff’s implantation, provide free genetic testing for all patients for the last five years and for babies born from implanted embryos, and disclose any testing disparities.
The suit also says the couple would be willing to keep the child but that she "should legally and morally be united with her genetic parents so long as they are fit, able and willing to take her," and alleges the parents had sought to be connected with the baby’s genetic parents by Jan.
