California appeals court upholds Weinstein’s rape conviction but orders resentencing
An appeals court upheld Harvey Weinstein’s 2022 rape and sexual assault conviction in California on Friday, but ordered his trial judge to resentence him.
The disgraced film tycoon, whose misconduct spurred a social movement in Hollywood, was found guilty of assaulting an Italian model in her hotel room during a film festival. Her identity was kept private during a trial in Los Angeles. Weinstein was sentenced to 16 years in prison. We are disappointed by today’s decision and respectfully disagree with the Court of Appeal’s conclusions regarding the fairness of Mr. Weinstein’s trial,” Juda Engelmayer, a Weinstein spokesperson, said in an email. “At the same time, the court correctly recognized that his sentence cannot stand.”
Weinstein’s lawyers, Jennifer Bonjean and Michael Freedman, had sought to overturn the conviction, arguing their client’s trial had been “doomed from the start” in a 2024 motion to appeal.
The attorneys took fault with the jury learning Weinstein had been convicted of rape in New York during jury selection, saying that knowledge “infected” the proceedings
